These Terms of Service ("Terms") govern your access to and use of somaandsoil.com (the "Site") and any purchase you make from Soma Soil, operated by Soma Soil ("Soma Soil," "we," "us," or "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

## 1. Eligibility

You must be at least 18 years old, or the age of majority in your state of residence, to purchase from the Site. By placing an order you confirm that you meet this requirement and that the information you provide is accurate.

## 2. Products

Soma Soil sells functional mushroom liquid drops and related products. We work to display our products and their descriptions, colours, and details as accurately as possible, but we cannot guarantee that your screen accurately reflects the product. As a natural botanical product, our drops may vary slightly in colour, taste, and appearance between batches. All products are subject to availability, and we may limit quantities or discontinue products at any time.

## 3. Dietary supplement and consumption notice

Our products are **dietary supplements**, not medicines. **These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.** Nothing on the Site is intended as medical or health advice. Our drops are designed to support your everyday baseline and are not a replacement for coffee, medication, sleep, or professional care.

If you are pregnant or nursing, taking medication, or have a medical condition, consult a qualified healthcare professional before use. Always review the product label and ingredients before consuming, do not exceed the suggested serving, and keep out of reach of children. If you have a known allergy to mushrooms or any listed ingredient, do not use the product.

## 4. Pricing and payment

All prices are listed in US dollars (USD). We strive for accuracy, but errors in pricing or product information may occur; we reserve the right to correct errors and to cancel any order placed at an incorrect price, even after the order has been confirmed. Payment is due at the time of purchase. You authorise us and our payment processors to charge your selected payment method for the total order amount, including taxes and shipping. Applicable sales tax is calculated and shown at checkout.

## 5. Orders

Your receipt of an order confirmation does not constitute our acceptance of an order. We reserve the right to refuse, limit, or cancel any order at our discretion — for example, in cases of suspected fraud, errors, or product unavailability. If we cancel an order you have paid for, we will refund you.

## 6. Subscriptions

If you purchase a subscription, you authorise recurring charges to your payment method, and your subscription will renew automatically until cancelled. Subscription billing, renewals, skipping, and cancellation are governed by our **Subscription & Cancellation Policy**, which is incorporated into these Terms.

## 7. Shipping

Shipping timelines, rates, and coverage are described in our **Shipping Policy**, which is incorporated into these Terms. Title and risk of loss pass to you upon delivery to the carrier.

## 8. Returns and refunds

Refunds and our 30-Day Money-Back Guarantee are governed by our **Refund & Returns Policy**, which is incorporated into these Terms. Because our drops are an ingestible product, we do not require you to ship the product back to receive an eligible refund.

## 9. Intellectual property

All content on the Site — including text, graphics, logos, images, photography, and the Soma Soil name and branding — is owned by Soma Soil or its licensors and is protected by intellectual property laws. You may not copy, reproduce, or use our content for commercial purposes without our prior written permission.

## 10. Customer reviews and submissions

If you submit a review, photo, comment, or other content to us or the Site, you grant Soma Soil a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and adapt that content for marketing and operational purposes. You are responsible for the content you submit and confirm it is accurate, lawful, and your own.

## 11. Acceptable use

You agree not to use the Site for any unlawful purpose, to interfere with its operation or security, to attempt unauthorised access, or to use automated means to scrape or collect data without our permission.

## 12. Disclaimers

The Site and products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the Site will be uninterrupted, secure, or error-free.

## 13. Limitation of liability

To the fullest extent permitted by law, Soma Soil will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, arising from your use of the Site or products. Our total liability for any claim relating to a product or order will not exceed the amount you paid for that order.

## 14. Indemnification

You agree to indemnify and hold harmless Soma Soil, and its officers, employees, and agents from any claims, losses, or expenses arising from your breach of these Terms or your misuse of the Site or products.

## 15. Governing law

These Terms are governed by the laws of Sweden without regard to conflict-of-law principles. You agree that any dispute will be subject to the exclusive jurisdiction of the courts located in Borås, Sweden, except where prohibited by applicable law.

We may update these Terms from time to time. The "Last updated" date above reflects the current version. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
